Separation Agreement between Husband and Wife

THIS AGREEMENT is entered into at [Location], this [Day] day of [Month], 20[Year], between Mr. John Doe, referred to as “the husband,” residing at [Husband’s Address], and Mrs. Jane Doe, referred to as “the wife,” residing at [Wife’s Address].

WHEREAS, the husband and wife have encountered irreconcilable differences leading to their current separation;

NOW, THEREFORE, THIS AGREEMENT WITNESSETH:

  1. Both parties agree to live apart from each other, with neither having authority or control over the other, and no legal actions shall be pursued for the restitution of conjugal rights.

  2. The husband agrees to pay the wife a monthly sum of Rs………… for her maintenance and the support of their children, subject to termination if the wife does not maintain a chaste life, with reasonable notice.

  3. The wife shall have sole custody and guardianship of their children, [Child C] and [Child D], until they reach the age of majority. The wife undertakes the responsibility of their maintenance and education, absolving the husband of any claims or demands related to the children.

  4. All debts incurred by the wife post the date of this agreement, whether for maintenance or otherwise, shall be her sole responsibility. The husband is not liable for these debts, and the wife indemnifies him against any claims arising from them.

  5. The wife is entitled to remove her personal belongings, including clothing, jewelry, and other effects, from the husband’s residence.

  6. The husband is granted access to the children every Sunday between 7:00 A.M. and 9:00 P.M., with sole custody during those hours.

  7. If the parties decide to reconcile and live together as spouses in the future, the monthly sum payable to the wife under this agreement will cease, and the terms of this agreement will be void.

  8. This agreement automatically terminates upon the death of either party.

  9. This agreement is executed in duplicate, with the original held by the husband and the duplicate by the wife.
